Առաջնորդվելով ՀՀ Սահմանադրության և «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» ՀՀ օրենքի վերաբերելի դրույթներով՝ վարչապետի կողմից 2021թ. փետրվարի 25-ին Հանրապետության նախագահին էր ներկայացվել առաջարկություն՝ ՀՀ ԶՈՒ գլխավոր շտաբի պետ Օնիկ Գասպարյանին զբաղեցրած պաշտոնից ազատելու վերաբերյալ՝ կցելով համապատասխան հրամանագրի նախագիծը:
2021թ. փետրվարի 27-ին վարչապետի աշխատակազմ են մուտք եղել Հանրապետության նախագահի առարկությունները վերոնշյալ նախագծի վերաբերյալ:
Նախագահի կողմից ներկայացված առարկությունները վարչապետի կողմից չեն ընդունվել, ինչի մասին 2021թ. փետրվարի 28-ին գրություն է ուղարկվել Հանրապետության նախագահին՝ համապատասխան հիմնավորումներով:
Հաշվի առնելով այն հանգամանքը, որ «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» ՀՀ օրենքի 35.1-ին հոդվածի 3-րդ մասով սահմանված ժամկետներում Հանրապետության նախագահը չի ստորագրել վարչապետի կողմից ներկայացված նախագիծը և չի դիմել
Սահմանադրական դատարան, հիմք ընդունելով Սահմանադրության 139-րդ հոդվածի 3-րդ մասը, ինչպես նաև «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» ՀՀ օրենքի 35.1-ին հոդվածի 6-րդ մասը և նույն օրենքի 40-րդ հոդվածի 3-րդ մասը` 2021թ. մարտի 10-ից ՀՀ ԶՈՒ գլխավոր շտաբի պետ Օնիկ Գասպարյանն իրավունքի ուժով համարվում է ազատված զբաղեցրած պաշտոնից:
Guided by the relevant provisions of the RA Constitution և “Military Service ՀՀ Law on the Status of a Soldier”, the Prime Minister in 2021 On February 25, a proposal was submitted to the President of the Republic to dismiss the Chief of the General Staff of the RA Armed Forces Onik Gasparyan from his post, attaching a draft decree.
2021 On February 27, the Prime Minister’s Office received the President’s objections to the above-mentioned draft.
The objections presented by the President were not accepted by the Prime Minister, about which in 2021 A letter was sent to the President of the Republic on February 28 with relevant justifications.
Taking into account the fact that the President of the Republic did not sign the draft submitted by the Prime Minister within the timeframe set forth in Article 35.1, Part 3 of the RA Law on Military Service կարգ Status of Servicemen, he did not apply to the Constitutional Court, based on Art
icle 139 3 3 of the Constitution. Part 6, as well as Article 35.1, Part 6 of the RA Law on Military Service and the Status of a Soldier, Part 3 of Article 40 of the same law, 2021. Onik Gasparyan, Chief of the General Staff of the RA Armed Forces, has been legally dismissed from his post since March 10, 2010.
